Privacy Policy

1. Introduction

Lumio ("we," "our," or "us") is committed to protecting the privacy of our users, particularly the students who utilize our platform and the parents or guardians who manage their accounts. This Privacy Policy outlines how we collect, use, and protect your data when you use the Lumio application at lumioprep.com.

2. Information We Collect

• Parent/Guardian Account Information: Name, email address, and billing details.
• Student Profile Information: Test type (SSAT or ISEE), target grade level, and study goals.
• Usage and Performance Data: Practice test scores, time spent on questions, selected answers, and scratchpad drawings.
• AI Interaction Data: Chat transcripts, voice inputs, and text interactions between the student and the Lumi Concept Tutor.
• Cookies and Analytics: We use standard cookies and lightweight analytics to keep you logged in, understand how the site is navigated, and monitor platform performance and bug reports.

3. Payment Processing

We use Stripe to process all subscription payments securely. We do not store or process your full credit card numbers or raw financial data on Lumio's servers. All transactions are subject to Stripe's privacy policy and security standards.

4. How We Process Data with Google Gemini

Lumio uses Google Gemini's enterprise API to power the Lumi Concept Tutor. Subject to our enterprise agreement with Google Cloud, we protect your child's data through strict boundaries:

• No Public Model Training: The prompts, questions, drawings, and voice inputs your child submits to Lumi are processed solely to generate a real-time response. Google is contractually prohibited from using your or your child's data to train its public foundational AI models.
• Data Isolation: Your interaction data remains within our secure API environment and is not shared with public Gemini consumer tools.
• Temporary Retention for Abuse Monitoring Only: Data sent to the Gemini API is encrypted in transit and is only retained temporarily by Google for automated abuse monitoring before being permanently deleted from their servers.

5. Children's Privacy (COPPA Compliance)

Lumio is an educational tool designed for elementary, middle, and high school students, but accounts must be created and managed by an adult (parent, guardian, or educator) over the age of 18.

• We do not knowingly collect personal information directly from children under 13 without verifiable parental consent. We rely on the verified credit card transaction during the subscription checkout process as our primary mechanism for establishing this consent.
• We never sell student data, show third-party behavioral advertisements to students, or create tracking profiles of students for non-educational purposes.
• Parents can review their child's data, request deletion of AI chat transcripts, or delete the account entirely at any time by contacting us.

6. How We Use Your Information

• To provide immediate Socratic feedback and grade practice questions.
• To adapt the difficulty of future questions based on student performance.
• To process subscription payments and provide customer support.
• To improve our internal educational curriculum and platform mechanics.

7. Data Security and Retention

We implement industry-standard security measures, including encryption at rest and in transit, to protect your data. We retain performance and chat data only as long as the account is active. Upon account deletion, all personal data and AI transcripts are permanently removed from our databases.

8. Changes to this Policy

We may update this Privacy Policy periodically. We will notify account holders of any material changes via email or a prominent notice on the platform prior to the changes taking effect.

Terms of Service

1. Acceptance of Terms

By accessing or using Lumio, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by emailing the address associated with your account or by posting an alert on the platform. Continued use of Lumio following such notice constitutes acceptance of the updated Terms.

3. Account Eligibility and Responsibility

• Age Requirement: You must be at least 18 years old to create a Lumio account and purchase a subscription. If you are allowing a minor to use your account to study, you are fully responsible for their conduct and compliance with these terms.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials. You may not share your account or subscription with other families.

4. The Lumi AI Concept Tutor (Disclaimer)

Lumio utilizes advanced generative artificial intelligence to provide the Lumi Concept Tutor. While we have rigorously engineered Lumi to provide accurate, Socratic guidance for the SSAT and ISEE:

• Nature of AI: Generative AI can occasionally make errors, misinterpret questions, or produce inaccurate statements.
• No Guarantees: Lumio is a supplementary educational tool. We do not guarantee absolute accuracy of the AI, nor do we guarantee any specific score increase, test percentile, or admission into any independent school.
• Students and parents should use their best judgment and verify critical mathematical or testing concepts if the AI's explanation seems unclear.

5. Fees, Billing, and Refunds

• 5.1. Free and Guest Modes: Users accessing the platform via Free Mode or Guest Mode are granted access to a maximum of 5 multiple-choice practice questions. We reserve the right to modify, suspend, or discontinue free access limits at any time without prior notice.
• 5.2. Paid Plans and Cancellations: Full access requires a paid subscription (e.g., Month-to-Month or Fall Bootcamp). By subscribing, you authorize us to charge your provided payment method. You may cancel your subscription at any time through your account settings. Cancellations apply to the following billing cycle; except as outlined in our guarantee below, we do not provide partial refunds for mid-month cancellations.
• 5.3. 14-Day Money-Back Guarantee: We offer a 14-day money-back guarantee for all new, initial subscription purchases. If you determine the platform is not the right fit, you may request a full refund within 14 days of your original transaction date by emailing support@lumioprep.com.
  • This guarantee applies strictly to your initial purchase and constitutes a one-time window per customer.
  • It does not apply to subscription renewals, subsequent purchases, or returning customers who have previously utilized the guarantee.
  • Upon processing the refund, your premium access will be immediately downgraded or revoked.

6. Acceptable Use

When using Lumio, you agree not to:

• Submit inappropriate, offensive, or harmful content to the Lumi tutor.
• Attempt to reverse-engineer, scrape, or extract the underlying AI prompts, questions, or curriculum database.
• Use the platform for anything other than personal, non-commercial test preparation.

7. Intellectual Property

All platform content, including practice questions, reading passages, interface design, branding, and the "Lumi" character, is the exclusive property of Lumio. You may not reproduce, distribute, or create derivative works from our content without explicit written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Lumio and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or educational opportunities, arising from your use of or inability to use the platform.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in King County, Washington.
